Before paying a rental reservation in Spain: pause and check

The flat looks suitable and the message says somebody else will take it unless you pay today. That is a good moment to slow the conversation down. Before sending money, separate three questions: what is being offered, who is offering it and what the payment would actually secure.
This is practical preparation for people considering a rental in Spain, including TrueCasa’s Motril–Marbella area. It is not a ruling that every advance request is fraudulent or that every reservation has the same legal effect. Have the actual proposed terms reviewed when you need advice.
Recognise pressure without jumping to conclusions
Spain’s Interior Ministry describes a rental-scam pattern involving unusually cheap advertisements, urgent advance reservations and an advertiser who disappears after payment. Police guidance on the same page advises comparing prices, treating repeated excuses for avoiding a physical viewing cautiously and being alert to requests to leave the original advertising platform. [1]
A warning sign is a reason to investigate, not proof about a particular advertiser. Keep your questions specific and record which answers remain unverified.
Check the home and the contact separately
Ask for the precise address and an agreed viewing. Keep the original listing and compare it with what is actually shown. Note rooms, access and any differences that matter to your decision. A video or attractive photograph can be useful context, but it is not a complete check.
Separately, ask who would sign the agreement and how their authority to offer the home can be independently checked. If an agent is involved, use contact details you have verified through their own established channel. A visit to the building does not by itself establish who owns it or who is entitled to collect a payment.
Protect documents as well as money
Catalonia’s official Cybersecurity Agency warns that fraudulent rental enquiries may seek identity documents, payslips or employment records for misuse. Its guidance also describes pressure to reserve, excuses for avoiding a viewing and advertisements using copied or generated photographs. This is cybersecurity guidance, not a statement of tenancy law for Andalucía. [2]
Before sharing sensitive documents, establish who is requesting them, the purpose and the secure route for providing them. Do not treat a logo in a message, a forwarded identity image or a convincing-looking website as sufficient verification.
Ask what the reservation payment means
As a practical checklist, request a written explanation of the amount, recipient, exact property and proposed dates. Ask what the payment would reserve, what happens if either side does not proceed, and whether it would be credited towards another agreed payment.
Ask for unclear cancellation or refund terms to be explained before paying. Do not assume a payment is refundable, non-refundable or legally required simply because it has been labelled a reservation. Keep the proposed agreement and relevant messages together for your adviser.
Give the viewing a clear purpose
Write down what you need the person attending to record and what needs another type of verification. For example: whether the shown home matches the listing, what areas were accessible and which questions remain for the agent or adviser. Keep “seen”, “stated by someone else” and “not verified” separate.
Human Eye, not AI
TrueCasa’s in-person previews mean a real person attending and recording observations within an agreed scope. That is what Human Eye, not AI means. Attendance can help you understand the home; it does not guarantee a transaction or replace checks on identity, authority and payment terms.
Our real inspection reports are on our website in the published business report library; access to individual reports may depend on your account. Illustrative rental samples explain the format separately and are not actual findings about the home you are considering.
Explore TrueView Rental services and fees. Local in-person previews are planned to start in the week beginning 2 November 2026, with access and appointments agreed in advance. For move-in preparation, see our rental inventory guide.
A message you can send
“Before I decide about a reservation payment, please confirm the exact property, who would sign the agreement, how their authority can be checked and the written payment and cancellation terms. Please also arrange a viewing and explain what remains to be verified.”
